Terms of Business

These Terms of Business is provided in accordance with the Consumer Protection Code issued by the Central Bank of Ireland.

1 About us

1. Our legal name is Fire Financial Services Limited (“FFSL”). Our registered office is at Dogpatch Labs, the CHQ Building, Custom House Quay, Dublin 1, Ireland and its company registration number is 464819.
2. FFSL is regulated by the Central Bank of Ireland and is a licenced Payment Institution (‘PI’) since 2010 and was subsequently re-authorised in accordance with Regulation 18 of the European Communities (Payment Services) Regulations 2018 on 2nd July 2018.

2 Regulated activities

2.1 FFSL is authorised to provide the following payment services:

1. Execution of direct debits, including one-off direct debits;
2. Execution of payment transactions through a payment card or a similar device;
3. Execution of credit transfers, including standing orders;
4. Issuing and/or acquiring of payment instruments;
5. Payment initiation services;
6. Account information services;
7. The provision of operational and closely related ancillary services such as ensuring the execution of payment transactions, foreign exchange services, safekeeping activities and the storage and processing of data;
8. The provision of a currency conversion service.

3 Codes of Conduct

3.1 FFSL is subject to the Payment Service Regulations, Prudential Requirements for Payment Institutions and the Consumer Protection Code. These codes offer protection to consumers and can be found on the Central Bank of Ireland website www.centralbank.ie

3.2 FFSL is also subject to the Principle of Treating Customers Fairly as per the Financial Conduct Authority’s (FCA) requirements. This Principle ensures the fair treatment of customers and can be found on the FCA’s website https://www.fca.org.uk/

4 EU Regulations

4.1 FFSL is subject to EU Regulations and in particular the General Data Protection Regulation. This regulation intends to strengthen and unify data protection for all individuals within the European Union (EU).

5 Fees and charges

5.1 FFSL charges its customers fees and charges in connection with the products and services provided by it. Information on Fees and Charges can be found in our Fees section of the website. Fees and charges may be amended from time to time by FFSL.

6 Data Protection Notice

6.1 The personal information requested from you is required for account opening checks. We will gather and process your personal data in compliance with the EU General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as well as the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 (together “Data Protection and Privacy legislation”).

7 Complaints

7.1 You may make a complaint by any of the following methods:

  • In writing, whether by letter, or email, or
  • verbally.

7.2 Your complaint will be fully investigated by FFSL. An acknowledgment letter will be sent to you upon receipt of your complaint and we will provide you with regular written updates. If you are dissatisfied with the outcome or if the complaint is not resolved within 35 business days, you are entitled to refer your complaint to the Financial Services and Pensions Ombudsman’s Bureau, Lincoln House, Lincoln Place, Dublin 2.

8 Changes to Terms of Business

8.1 Where there are any material changes to these Terms of Business we will give you notice of any proposed change by any combination of an e-mail, posting a notice on our Website or through the Fire App.

8.2 The Terms of Business (v2.2) is effective from 18th October 2022.

1.2 Fire-UK is authorised as an E-Money Institution (EMI) by the Financial Conduct Authority since 2019.

2 Regulated activities

2.1 Fire-UK is authorised to provide the following e-money and payment services:
a) Services enabling cash placement on a payment account
b) Services enabling cash withdrawals from a payment account
c) Execution of payment transactions (not covered by a credit line)
d) Execution of payment transactions (covered by a credit line)
e) Issuing payment instruments or acquiring payment transactions
f) Money remittance
g) Issuing Electronic Money
h) Payment initiation services
i) Account information services

3 Codes of conduct

3.1 Fire-UK is subject to the legislative requirements within the Electronic Money Regulations 2011 and Payment Service Regulations 2017.

3.2 Fire-UK is also subject to the Prudential Requirements within the FCA Handbook and the FCA Principle of Treating Customers Fairly Consumer. These codes offer protection to consumers and can be found on the FCA’s website https://www.fca.org.uk/.

4 Fees and charges

4.1 Fire-UK charges its customers fees and charges in connection with the products and services provided by it. Information on Fees and Charges can be found in our Fees section of the website. Fees and charges may be amended from time to time by Fire-UK.

5 Data Protection Notice
